Before any online purchasing on the ONETILE.IT website managed by ONE CLICK TILES S.R.L., CUSTOMERS are requested to carefully read the following general terms and conditions:

These conditions apply to all users, the purchase implies acceptance of these conditions that are always available at ONETILE.IT and are known before the conclusion of the contract (Article 1341 c.c.).

The PRODUCTS must be in principle conform to the sample supplied by the seller, pursuant to art. 1522 paragraph 2 C.C. In particular, any discrepancy on the following features such as color shading, grain and knot will not constitute non conformity, while refinishing and color are considered essential.

The CUSTOMER shall provide the payment methods he/she intends to use, which shall also apply in case of reimbursement at the point of withdrawal, unless otherwise specified.

Payments shall be made using encrypted methods to protect the security and confidentiality of transactions.

The Customer, if he acts as CONSUMER according to the Consumer Code, pursuant to the provisions of article 52, paragraph 1, of the Code of Consumption, shall have a period of 14 (fourteen) days in which to withdraw from the Contract, without giving any reason, as from the time of physical delivery of the products or the last batch if the shipment is split into several moments.

The CLIENT must inform ONE CLICK TILES S.R.L. of his/her decision to exercise the right of withdrawal from this Contract, within the terms established in the previous paragraph: a) using the withdrawal form referred to in Annex I, part B of the Consumer Code; or b) by submitting to ONE CLICK TILES S.R.L. any other explicit statement of the decision to withdraw from this Agreement.

With reference to the assessment of quality standards the seller relies on the manufacturer’s instructions. The buyer is required to document any product defects with video footage or pictures as detailed as possible.

ONE CLICK TILES S.R.L. shall lend, in relation to the Products purchased by the consumer Customer, the legal guarantee of conformity to the conditions and terms set forth in articles. 128 et seq. of the Consumer Code.

In particular, the rights arising from this guarantee are to be exercised provided that the Products have been used correctly, with due diligence and in accordance with the intended use and as provided in the enclosed instructions, as well as prior exhibition by the Customer of the delivery note received and indication of the order number. The expenses related to the return of products due to the exercise of the guarantee shall be charged to the Consumer. The warranty rights of the consumer customer are prescribed in the legal terms referred to in art. 132 of the Consumer Code subsequently reported:

1. The seller is liable, in accordance with Article 130, when the lack of conformity occurs within two years from delivery.

2. The consumer loses the rights provided for in article 130, paragraph 2, if he does not report the lack of conformity to the seller within two months from the date on which he discovered the defect. The complaint is not necessary if the seller has acknowledged the existence of the defect or has concealed it.

Unless proven otherwise, it is presumed that the conformity defects that occur within six months from the products delivery already existed on that date, unless this hypothesis is incompatible with the nature of the goods or with the nature of the lack of conformity. In any case, the action intended to asserting the defects not maliciously concealed by the seller is prescribed within twenty-six months from the products delivery; the consumer, that has agreed to the execution of the contract, can nevertheless always assert the rights referred to in Article 130, paragraph 2, provided that the lack of conformity has been reported within two months from the discovery and before the expiry of the deadline provided for in the previous period.

The guarantee rights of professional Clients, ie non-consumers, are governed by the current provisions of the Civil Code concerning the sales contract. In any case, with regard to any complaints for faults or defects of the goods shipped that are not recognizable or expressly accepted by the purchaser, even if generated during packing operations, ONE CLICK TILES SRL must be informed in writing, within 8 days from the discovery of the defects . The Customer must document any defect and report with pictures that show the damage to the products.

If the product sold is defective, ONE CLICK TILES S.R.L. reserves the right to offer to the Customer partial refund of the purchase price to an extent appropriate to the seriousness of the defect, or the replacement of the Product. This last option is excluded for minor defects that do not affect in any way the intended use or the external appearance of the Product.

Damages caused by improper and / or incorrect use are not under warranty and therefore no liability is assumed for direct or indirect damage resulting from such misuse. Furthermore, no responsibility is taken for direct or indirect damages to people or things due to product malfunctioning.

This contract is governed by Italian law, in particular the current Civil Code and the Consumer Code (Legislative Decree No. 206/2005 and subsequent amendments and additions) and by Legislative Decree no. 70/2003 on electronic commerce. The competent court is that of Brescia, without prejudice to the arrangements laid down for contracts concluded by consumers. In case of cancellation or ineffectiveness of one or more clauses, the contract remains valid for the remaining part. ONE CLICK TILES S.R.L. reserves the right to modify, in full or in part, these terms and conditions that will be valid 15 days after publication.

Within the meaning and for the purposes of art. 14 of the EU regulation n.524 / 2013, consumers resident in the European Union are informed that for the resolution of disputes related to this contract and the online services offered by this website, it may be considered to resort to the Online Dispute Resolution procedure (ODR), provided by by the European Commission, available for consultation at the following link: https://webgate.ec.europa.eu/odr/.
